1. Scope and seller

(1) These terms and conditions apply to all orders placed in the online shop alexanderschill.com (Alexander Schill Shop).

(2) Your contract partner is AS Equestrian / Alexander Schill, Viehweiderweg 8, 77743 Neuried, Germany, phone +49 172 628 4843, email info@alexanderschill.de, VAT ID DE369036964 ("we").

(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 of the German Civil Code, BGB).

(4) Deviating terms of the customer only apply if we expressly agree to them.

2. Conclusion of the contract

(1) The presentation of products in the online shop is not a legally binding offer but an invitation to order.

(2) You add products to the cart and go to checkout. There you enter your contact and delivery details and choose a shipping and payment method. Before submitting, you see all details again and can correct input errors using the edit fields or your browser's back button. By clicking the order button, you make a binding offer to buy the products in your cart.

(3) After submitting, you receive an order confirmation by email. With this order confirmation we accept your offer, and the purchase contract is concluded.

(4) The contract languages are German and English.

(5) We store the contract text. You receive your order details with the order confirmation email. You can view, print and save these terms on this page at any time. If you have a customer account, you can also see your orders there.

3. Prices and shipping costs

(1) All prices are final prices and include statutory VAT.

(2) Shipping costs are added. They depend on the destination country and weight and are listed in our shipping policy. Shipping costs are shown in the cart and at checkout before you submit your order.

(3) We deliver to Germany and all other countries of the European Union.

4. Payment

(1) The available payment methods are shown at checkout, for example credit card, PayPal, Apple Pay, Google Pay and Klarna.

(2) The purchase price is due when the contract is concluded. For payments through payment providers such as PayPal or Klarna, their terms also apply.

5. Delivery

(1) We ship orders within 1 business day. The total delivery time from order is 1 to 3 business days in Germany, 2 to 5 business days to other EU countries and 5 to 8 business days to Cyprus and Malta.

(2) If an ordered product is not available, we inform you without delay and refund any payments already made.

6. Retention of title

The goods remain our property until paid in full.

7. Right of withdrawal

As a consumer, you have a statutory right of withdrawal of 14 days. For details, including the model withdrawal form, see our refund policy.

8. Warranty

The statutory rights for defects apply. Guarantees only exist where expressly stated.

9. Liability

(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and under any guarantees given.

(2) For slight negligence, we are only liable for breach of an essential contractual obligation, meaning an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely. In this case, liability is limited to the foreseeable damage typical for this type of contract.

(3) These rules also apply to persons we use to perform our obligations.

10. Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

11. Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies to the extent that it does not deprive them of the protection of mandatory provisions of the law of the country in which they have their habitual residence.

(2) If individual provisions of these terms are invalid, the validity of the remaining provisions is not affected.
